Proctor Phair Lawyers acted on behalf of a client who had been served with a creditors petition by filing a notice of motion to set aside the judgment in the Local Court and stay a creditors petition pending determination of the motion which was successful and resulted in the creditors petition being dismissed and the client being granted leave to file a defence in the Local Court proceedings, which proceedings were ultimately settled on a commercial basis.
